The actual implementation of labour rights is possible if the legislation has
working mechanisms for the protection of violated rights. The effectiveness of
such protection depends, among other things, on the procedural rules
establishing the position of the disputing parties, their rights, obligations,
and the rules of distribution of the burden of proof. In this article, we will
focus on the norms establishing the rules for the distribution of the burden of
proof of the circumstances relevant to the resolution of a labour dispute.
